Sulla Gazzetta n. 106 del 9 maggio scorso è stato pubblicato il Decreto del Ministero delle Infrastrutture e dei Trasporti 30 aprile 2009 recante “Rilevazione dei prezzi medi per l'anno 2007 e delle variazioni percentuali, su base semestrale, superiori all'8 per cento, relative all'anno 2008, ai fini della determinazione delle compensazioni dei singoli prezzi dei materiali da costruzione piu' significativi.”.
Tale provvedimento è stato emanato in attuazione delle disposizioni dell’art.1 del D.L. 162/2008.La L. 201/2008, legge di conversione del D.L. 162/2008 che conteneva misure straordinarie for 2008 for adjustment of prices of building materials, was published in the Official Gazette No 298, December 22 2008.Per cope with the rapid increases in prices of some construction materials that occurred in 2008, the Government issued Decree 23 October 2008, No 162, which operates notwithstanding the provisions of paragraphs 4, 5, 6, 6-bis of art. 133 of Legislative Decree no. 163/2006.
This regulation provides that the Ministry of Infrastructure and Transport detect percentage changes on a yearly basis, the rise or fall over through eight per cent for the year 2008, the individual prices of construction materials more significativi.L 'Art. 1 of Legislative Decree 162/2008 provides inter alia that:
compensation is determined by applying the unit prices of the materials multiplied by the amount recorded in 2008 by the Director of the work, the rate that exceeds eight percent;
to get the compensation the contractor must submit to the contracting authority, in penalty of forfeiture, a 'special request within thirty days from the date of publication in the Official Gazette of the Decree of the Ministry of Infrastructure;
the adjustment does not apply where the proceeding officer is satisfied that, compared to the time schedule, a delay in going works chargeable to the contractor.
The text of Decree 162, after changes in the conversion, provides for the detection price is available on a semestrale.La compensation must also be determined by applying the changes (increase or decrease in prices) in excess of 8% if referred only to the year 2008 in excess of 10% if referred to total more years .
MD April 30, 2009 shows, in three annexes, respectively
building materials with variable percentage (1st and 2nd half of 2008 over year 2007) over 8%;
building materials with variable percentage (2 first half of 2008 to 1 st half 2008) more than 8%;
the percentage change in 1 st and 2 nd half of 2008 to 2003, 2004, 2005, 2006.
